1. Introduction
The general terms and conditions of sale detailed below only govern the contractual relationship between the User (hereafter referred to as You) and the trader Esengo (hereafter referred to as We) belonging to the company K-LALA SARL with a capital of 9418,68 Euros, whose headquarters is situated at 190, rue Lannoy- 59100 Roubaix and registered on the register of companies and commerce in Roubaix-Tourcoing under the number 491 133 468. Both parties accept these conditions unreservedly. These general conditions of sale are the only conditions that are applicable and replace all other conditions, except in the case of express, written prior dispensation. We maintain that, by confirming your order, you unreservedly accept our general conditions of sale, having read them. These Terms and Conditions of Sale are important to you and Esengo as they have been designed to protect your rights as a valued customer and to protect our rights as a business and to create an understanding between us.
2. Ordering
There are 4 different ways of placing an order:

- by ordinary mail with your order printed out and your payment addressed to Esengo 190 rue Lannoy 59100 Roubaix France. We will send you confirmation by e-mail that we have received your order.
The ordering process consists of four (4) easy steps. Once you have chosen the products you would like to buy and have confirmed your basket, you must: - log in; - choose your delivery method;
- accept the general terms and conditions of sale by ticking the box reserved to this effect on the order summary page (entitled " Order summary ");
- select your method of payment.
Once you have chosen your method of payment, you must pay for your order, which legally finalises the purchase agreement made with Esengo.
3. Product information
Esengo takes great care when putting information on-line with respect to the essential characteristics of our products, notably with respect to the technical descriptions emanating from our partners and suppliers and the photographs illustrating the products; this however, within the technical limits that exist and with respect for the best standards on the market.
4. Prices
The prices indicated on the Site are in Euros and include all taxes but do not include delivery.The chosen possible delivery costs are indicated for the User during the product selection and are invoiced at the end of the order in addition to the price of the products.
There is a free delivery for any orders over 50 euros in France (Mainland). There is a 10% discount offered for any orders over 50 euros for the rest of Europe.
We reserve the right to modify our prices at any moment but will apply the current rates as indicated to you on the site at the time the order was placed.
5. Availability
Please note that we will honour your order while stock is available.
In the event where one of the products ordered is not in stock, we will contact you in less than 2 working days as of your order date to inform you how long it will be before we are able to deliver the product.
If there are certain products that are temporarily unavailable, we will send the available products and will pay the shipping fees for the rest of the order. We will offer you a replacement for an unavailable product, a product of equal price and quality.
If you choose to refuse, we will reimburse the unavailable product. If you wish to return it to us in the conditions outlined in article 9 (right of retraction - satisfied or reimbursed), the fees will be covered by us.
6. Delivery methods
The products bought on the Site will be delivered to the following countries :
France, Germany, Belgium, Netherlands, Luxembourg, Great Britain, Italy, Spain, Austria, Denmark, Eire, Portugal, Finland, Norway, Sweden, Switzerland, Greece, Hungary, Iceland, Poland, Czech Republic, Slovakia and Slovenia.
Your order will be delivered to the address you indicated when you placed your order.
When the products bought are available, the estimated date of delivery will be calculated with the two following elements:
1. The dispatching time (24 - 48h) checking of the reliability of your information seized as from the taking into account of your payment + preparation of your order + dispatching of your parcel or parcels to the conveyor.
The delivery time of your parcel by the conveyor of your choice.

The deadline of delivery of your order will be communicated to you on the website in your "summary orders".
In the event of a delay of delivery of more than 7 days, in comparison with the announced deadline, you have the possibility of cancelling your order by may. In this respect, we commit ourselves refunding you the sums paid within 30 day.
Esengo offers several methods of delivery:
Express delivery
This method of delivery allows you to receive your package in 24 to 48 hours. You will be delivered by us. This possibility is only offered to customers living in the northern part of France.
Standard delivery
This choice of delivery enables you to receive your parcel under 48h thanks to the Post office and "the Colissimo suivi" service.
Your order placed before 14:00 will be treated in the course of the day if the product is available. The parcel is then dispatched to the Post office and is on your premise under 48h-72h in Mainland France and three to four days for the rest of Europe.
The expenses engaged for this option depend on the selected article.
If your order is lower than 100€ including all taxes, your parcel is delivered to you without signature in your residence, or in your letter-box if you are not home, or at the post office if dimensions of the parcel require it. If your order is higher than 100€ including all taxes, the postman will ask you for a signature with the delivery. In case you are not home, a advice note is deposited in your letter-box and allows you to withdraw your parcel at the post office. The parcels are held at the Post office during 15 days.
In the event of non reception of a parcel within the times indicated, a survey is carried out with the conveyor and can take several days (ex: 21 days with the French Post).
However, in the event of going beyond of the deadline of delivery exceeding seven (7) days and non due to a case of major force, you can cancel your order by registered letter with marked reception. You will then be refunded within thirty (30) maximum days.
Upon reception of your order, we recommend that you verify your products with the order that you placed with us and if necessary, write any anomalies that may have occurred on the delivery voucher, not forgetting to sign it. Without prejudice and with respect to the applicable legal guarantees, we recommend that you address any reservations you may have pertaining to malfunctioning products on the date of delivery as quickly as possible by Post to the following address or by e-mail: Esengo 190 rue de Lannoy 59100 Roubaix, France, fax (+33 359350205).
7. Secure payment
Esengo offers 4 methods of payment: Credit card (Debit card, Visa or MasterCard), Three monthly payment, bank transfer, French bank cheque and PayPal.
When you pay by credit card, your account will be debited when your order is forwarded, on condition that we have received pre-authorisation for your account. If sufficient funds are not available, your order will not be taken into account. For payments made on-line by credit card, the "Secure Socket Layer" (SSL) system of security is used, which allows for encrypting your banking information when on the network. Bank transfer payment: Your payment will be processed when your bank transfer is received. Once your payment is received we will dispatch your goods. The processing of off-line payments may take several days.
Payment by cheque: you just have to forward to us, accompanied by your summary of order and a photocopy of your ID, your cheque made out to: K-LALA to the address Esengo 190 rue de Lannoy 59100 Roubaix, France. As of the reception of your cheque, we dispatch you your order to you.
Accepted credit cards: Esengo, Carte bleue, Visa, Mastercard.
Please, note:
In accordance with our commitment on the payments safety, we inform you that Esengo checks the reliability of the information given during the recording of an order.
This falls under our will to fight against the frauds with means of payment on Internet and thus to protect consumers.
Consequently, our service of prevention of the frauds might require from you, in certain cases, additional details (such as: copy of ID, document in proof of residence) in order to validate your purchase and to thus dispatch your parcel.
In this case, in order to ensure the forwarding of your order in the intended deadlines, we recommend to you to indicate a phone number where you will be easily reachable, and to confirm information given or to send the documents requested in the course of the day.
If you wish to avoid having to communicate such information to us, we recommend to you to proceed to a payment by bank transfer.
8. Right of Retraction - Satisfied or your money back
Esengo allows you 15 days to return a product that you are not satisfied with. Your right of retraction starts from the moment your order is delivered. You can return the product within this time period, at your own expense, accompanied by your invoice and a completed and signed return goods voucher.
We request that you send us the merchandise by registered post and that you purchase insurance with the carrier for the value of the merchandise. This is notably necessary should they lose or damage the goods. Shipping fees remain the customer's responsibility.
The present right of return only applies to products that are returned in their original, complete working condition (packaging, accessories, user guide etc.). Any product that has been damaged, or is not in its original packaging, or has packaging that has been worn beyond simply opening the product, will not be refunded.
For reimbursements:
- If the product is returned within 7 days of its delivery, the User will be reimbursed by bank transfer if payment was made by bank card, or by cheque in other cases.
- If the product is returned between the 8th and 15th day after purchase: you will be refunded in the form of gift vouchers
9. Returns
For any return of parcel, you must send them registered by the Post office (or another conveyor).
Please note that the carriage costs are to be paid by the customer.
10. Guarantees and After-Sales Service
All of the products we sell benefit from:
- The legal guarantee of conformity;
- The legal guarantee from hidden flaws;
- The manufacturer's guarantee for a period defined by the product purchased and the brand. Shipping fees of the products are the customer's responsibility.
However, if the product does not conform to the product description, shipping fees will be reimbursed to the customer.
Esengo will handle possible repairs with the manufacturers.
Whatever the problem is with your product, you must attach, with the defective product, a copy of your invoice, the warranty (in the box) and the return goods voucher.
Please note that legal guarantees do not apply to repairs for damage caused by external origin (for example, accidents, shocks, fluctuation of electricity etc.) or by the user's faulty usage of the product such as a non-conforming installation or using it for commercial purposes or using said product with incorrect peripherals, accessories or consumables. The manufacturer's warranties sold by ESENGO do not cover: -replacement of consumables (batteries, light bulbs, fuses, recording heads or lasers etc.), -the abnormal use or non-conforming usage of products. We ask that you consult the user's manual provided with the products-malfunctioning due to accessories (power cables etc.) -damage from external sources (shocks, accidents, electricity current fluctuations etc.). In all cases, ESENGO will not be held responsible in the event that the manufacturer refuses to honour the warranty due to, but not limited to, any of the above noted reasons. In the event where the manufacturer will not provide service under warranty, an estimate of the cost of the repair will be given to the customer. Administrative fees will be requested if payment for the estimate is not made. If the User agrees to the estimate, a cheque will be issued to K-LALA and will correspond to the estimate amount, and ought to be sent to us.
11. Responsibility
This contract is subjected to the French laws.
Esengo will not be held liable for poor use and its consequences on the products purchased from our Site. Although our products have performance that is compatible with professional usage, Esengo does not sell products for professional usage.
12. Protection of personal data
Since the details you give us are essential for the processing and delivery of orders, for billing and for the establishment of warranty contracts, failure to provide these details will result in the cancellation of your order.
By registering on the Site, you agree to provide us with sincere and true information as it concerns you.
Communicating false information is contrary to the present General Conditions as well as the conditions of use listed on the Site.
In accordance with the "Data processing and Freedoms" law, the processing of your details was the subject of a declaration made before the CNIL (French data protection watchdog).
Esengo is authorised to extract, handle and use information that concerns you.
This information is the subject of computer processing.
This activity is strictly regulated: The file must be declared to the CNIL under the number.
You have the permanent right to access and rectify all the information that concerns you, in accordance with European texts and national laws in place (article 34 of the law of 6 January 1978). You can at any time make a request to Esengo to find out what personal information they have concerning you. You may at any time, and by request, modify this information. If you accepted to receive our promotional e-mails when you registered on the Site, offers including new items, clearance, exclusivities, good deals etc. will be sent to you. You may at any time request not to receive any further e-mails from us by clicking here or on the link created for this purpose and inserted at the bottom of each page of our or our partners' emails.
Only Esengo has information regarding you.
If you accepted registration on the Site, Esengo and its contractual partners may send you information concerning particular and occasional promotions.
Esengo's partners have been specially chosen by Esengo and are recognised for the quality of their products and services.
We would like to remind you that cookies record certain information stored on your hard drive. This information enables us to generate statistics based on data from visitors to our site and suggest products that might interest you according to the items that you selected when you previously visited the site. Before any information is recorded, an alert message will ask you whether you would like to enable cookies, and you may refuse if you wish. Cookies do not contain any confidential information about you.
13. Intellectual ownership
All the content on the Esengo site (illustrations, texts, names, brand names, images and videos) is the property of Esengo, its co-contractors or partners. Any partial or total reproduction of this content, by any means and on any support, is subject to prior and express authorisation by Esengo.
All information, content, files and software offered by our services is protected by French and International law concerning intellectual ownership and copyright.
Esengo cannot give you the right to copy, display or distribute content that you do not have the intellectual rights to. All fraudulent use of this content that violates the rights held by a third party constitutes an offence of forgery, which is severely punished under the Intellectual Property Code.
Esengo will not, under any circumstances, be held responsible if a user violates rights held by a third party through his activities on the site.
